After failing to reach a verdict Tuesday, a jury of 7 women and 5 men today will continue deliberating the fate of accused Marathon bomber Dzhokhar Tsarnaev. Tsarnaev faces 30 charges, of which 17 carry the possibility of the death penalty.
The charges are laid out over 32 pages. 17 capital punishment qualified charges-- counts 1 through 10 and 12 through 18—include the planting of a bomb and the killing of MIT police officer Sean Collier .
Also being considered is the charge: the use of a weapon of mass destruction resulting in death. The jury is considering if Tsarnaev was responsible for a pressure cooker bomb placed in front of Marathon Sports at 671 Boylston and another placed in front of the Forum Restaurant at 755 Boylston Street. There are two counts on this charge.
The defendant is further charged with possession and use of firearm during and in relation to a crime of violence resulting in death. There are nine counts of this charge, including three connected to the murder of MIT officer Sean Collier.
Six of the of the firearm charges against Tsarnaev entail pressure cooker bombs. Three others involve the Ruger 9mm pistol used to kill Collier and engage police in a firefight in Watertown.
Other charges include conspiracy to bomb a place of public use resulting in death and conspiracy to use a weapon of mass destruction resulting in death. Jurors are considering whether—as the US government contends-- Dzhokhar Tsarnaev joined with his brother Tamerlan in planning the attack from soup to nuts. During the trial prosecutors showed video tape and photos proving that Tsarnaev and his brother had driven to a New Hampshire gun range and practiced shooting prior to the attacks.
The defense says that older brother Tamerlan masterminded the violence, but the government says Dzhokhar was spurred by what it characterized in closing arguments as an anti-American agenda, complete with his own theme music allegedly found on his electronic devices.
The government says Tsarnaev also derived inspiration from a radical American, Al Qaeda in Yemen cleric Anwar al-Awlaki, now deceased:
The carjacking is one of 13 non-death penalty charges. If Tsarnaev is found guilty of any of the other 17 the jury can and will consider executing the 21 year old defendant in the next phase of this trial: Sentencing.
