GBH “TEXT MESSAGE SERVICE” TERMS OF USE
By “Opting In” to or using a “Text Message Service” (as defined below) from GBH, you accept these Terms and Conditions.
This agreement is between you and the WGBH Educational Foundation (“GBH”), a non-profit charitable Massachusetts corporation, having its principal place of business at One Guest Street, Boston, MA 02135. All references to “GBH,” “we,” “our,” or “us” refer to the WGBH Educational Foundation and include GBH employees and other authorized users acting on GBH’s behalf in connection with the Text Message Service.
DEFINITIONS
“Opting In,” “Opt In,” and “Opt‑In” refer to requesting, joining, agreeing to, enrolling in, signing up for, acknowledging, responding to, providing your mobile phone number to GBH for the purpose of conversational person-to-person communication, initiating contact with GBH via a Text Message Service, or otherwise consenting to receive one or more text messages.
“Text Message Service” includes any arrangement or situation in which GBH sends one or more text messages to your mobile phone number, including Short Message Service (“SMS”), Multimedia Messaging Service (“MMS”), or successor protocols or technologies, through Microsoft Teams, Zoom, or another GBH‑authorized communication platform (each, an “SMS Platform”). For clarity, a Text Message Service does not include any GBH fundraising, membership, promotional, marketing, bulk, or automated messaging programs, each of which may be governed by its own terms and policies and is not covered by these GBH Text Messaging Terms of Use.
ELIGIBILITY
You must be at least eighteen (18) years of age, or the age of majority in the jurisdiction in which you reside, to use a Text Message Service to communicate with GBH. By Opting In to or participating in a Text Message Service, you represent that you are at least eighteen (18) years of age or the age of majority in the jurisdiction in which you reside.
CONSENTING TO TEXT MESSAGING
By Opting In to receive text messages from GBH, you agree to these GBH “Text Message Service” Terms of Use, as well as the GBH Privacy Policy and GBH Terms of Use, each incorporated herein by reference.
If there is a conflict between these GBH Text Message Service Terms of Use and the incorporated GBH Terms of Use, these GBH Text Message Service Terms of Use control for matters relating to Text Message Services.
USER CODE OF CONDUCT FOR TEXT MESSAGING
When using a Text Message Service, you agree that you will not send, submit, or transmit any message content that is unlawful, harmful, abusive, threatening, harassing, defamatory, or obscene.
You may not use a Text Message Service to evade Opt‑Out requests, to attempt to bypass any measure implemented by an SMS Platform or a communications provider designed to enforce messaging rules, or to engage in unauthorized bulk, automated, or promotional messaging.
E‑SIGN DISCLOSURE
By agreeing to receive text messages, you consent to the use of an electronic record to document your agreement. You may withdraw your consent to the electronic record by replying STOP to any text message.
GBH TEXT MESSAGE SERVICE PRIVACY POLICY
Your mobile phone number and the contents of any text messages you send to us through a Text Message Service, including any personally identifiable information you choose to provide, may be collected and stored by us. GBH may use the contents of these text messages for legitimate business purposes or as otherwise indicated at the time of collection, which may include sharing information with telecommunications carriers, SMS Platforms, and other vendors who assist in the technical delivery of text messages, and as may be required under applicable law. GBH will not use your mobile phone number or text messages for marketing or promotional purposes. Your Opt‑In information and consent will not be shared with any third parties. GBH may disclose information as necessary to comply with law, regulation, or governmental request, to avoid liability, or to protect our rights or property. This GBH Text Message Service Privacy Policy applies solely to your use of the Text Message Service and does not modify the general GBH Privacy Policy, incorporated by reference above, which may govern our relationship with you in other contexts.
CONFIDENTIALITY
Except as may be required in connection with filings with governmental agencies or courts, or except as may be required under applicable law, you shall not disclose, forward, copy, or distribute to any third party, except on a need‑to‑know basis to your lawyers, accountants, advisors, banks, and trustees, all of whom shall agree to keep confidential any information they so obtain, any information obtained by you from GBH via a Text Message Service that GBH has identified as confidential or that a reasonable person would understand to be confidential, including but not limited to information that relates to GBH’s past, present, or future research, development, product procedures, objectives, techniques, and business activities. This obligation does not apply to information that is or becomes publicly available through no fault or action of your own.
COSTS OF TEXT MESSAGES
GBH does not charge you for messages you send or receive through the Text Message Service. Message and data rates may apply depending on your mobile plan and carrier.
FREQUENCY OF TEXT MESSAGES
The Text Message Service is used for conversational, person‑to‑person communication between you and GBH. GBH may send an initial message confirming your Opt‑In. Subsequent message frequency will vary and depends on your interaction with GBH, including whether you take actions that generate additional messages, such as replying with the keyword HELP.
OPTING OUT OF TEXT MESSAGES
If you no longer wish to receive text messages from GBH, you may opt out at any time by replying to any message with STOP, QUIT, END, REVOKE, OPT OUT, CANCEL, or UNSUBSCRIBE. Because Text Message Service conversations are one‑to‑one, opt‑outs apply to the specific conversation and phone number associated with the GBH employee who contacted you. After you opt out, GBH may send a confirmation of your opt‑out via text message.
CHANGES TO THESE TERMS
GBH may update or modify these GBH Text Message Service Terms of Use from time to time. Any updated version will be effective upon posting. If you continue to participate in a Text Message Service after changes are posted, you will be deemed to have accepted the updated Terms. If you do not agree to the changes, you must stop using the Text Message Service.
