Assumption of Risk and Waiver of Liability:
All attendees must comply with WGBH Educational Foundation’s [“GBH”] Safety Guidelines, as communicated by GBH employees before or during the event.
Effective June 20, 2022, masking is recommended to minimize the spread of COVID-19 and as protection for those with heightened risk factors.
GBH will continue to require face coverings for any guests attending events who have not been vaccinated. These guests must remain masked at all times while inside GBH property. Failure to comply with GBH’s Guidelines may result in immediate removal from the venue, at GBH’s sole discretion. If you are removed from the event due to such noncompliance, you understand that you will forfeit the ticket price and any other fees you paid or expenses incurred to attend the event. GBH’s Safety Guidelines may change as public health circumstances change.
In addition, by attending this event, you are certifying that you (1) do not have COVID-19, (2) have not had known or suspected exposure to COVID-19 within the last fourteen days, and (3) are not experiencing any COVID-19 symptoms (e.g., fever or chills, cough, shortness of breath, fatigue, aches, headache, new loss of taste or smell, sore throat, congestion or runny nose, nausea or vomiting, diarrhea).
ASSUMPTION OF RISK: While preventative measures have been put in place to reduce the risk of spreading COVID-19, GBH cannot guarantee that you or other attendees of this event will not be exposed to or become infected with COVID-19. By attending this event, you are certifying that you understand that (1) COVID-19 is extremely contagious and is spread mainly from person-to-person contact, (2) the event will not be socially distanced, (3) any interaction with others in connection with the event may expose you and your family to and increase your risk of contracting and spreading COVID-19, (4) there is no known cure for COVID-19, and (5) scientific evidence has shown that COVID-19 can cause serious and potentially life threatening illness and even death. You are voluntarily attending this event and assuming the known risks of being exposed to, contracting, and/or spreading COVID-19 as a result of your attendance at the event.
WAIVER OF LIABILITY: BY ATTENDING THIS EVENT, YOU HEREBY FOREVER RELEASE AND WAIVE ALL CLAIMS AND RIGHTS AGAINST WGBH EDUCATIONAL FOUNDATION (“GBH”), ITS MEMBERS, OFFICERS, TRUSTEES, EMPLOYEES, CONTRACTORS, AGENTS, AND REPRESENTATIVES (THE “RELEASED PARTIES”) IN CONNECTION WITH EXPOSURE TO, INFECTION AND/OR SPREAD OF COVID-19 RELATED TO ATTENDING THE EVENT SPONSORED, ORGANIZED, HOSTED OR OFFERED BY GBH. YOU UNDERSTAND THAT THIS WAIVER MEANS YOU GIVE UP YOUR RIGHT TO BRING ANY CLAIMS INCLUDING FOR PERSONAL INJURIES, DEATH, DISEASE OR PROPERTY LOSSES, OR ANY OTHER LOSS, INCLUDING BUT NOT LIMITED TO CLAIMS OF NEGLIGENCE, AND YOU GIVE UP ANY CLAIM YOU MAY HAVE TO SEEK DAMAGES, WHETHER KNOWN OR UNKNOWN, FORESEEN OR UNFORESEEN. YOU SPECIFICALLY GIVE UP YOUR RIGHT TO INITIATE SUIT AGAINST THE RELEASED PARTIES FOR ANY MATTER CONTEMPLATED BY THIS WAIVER OF LIABILITY.
